www.hearingwithanaid.com is a Site intended for consumers interested in learning about hearing aid products. The following Terms of Service govern your access to and use of the Site and represent a legal agreement between you and the Site. Under no circumstances will the Site be responsible for any loss, damage or injury resulting from any use of the Site whatsoever. The Site disclaims any and all representations, warranties, promises or guarantees regarding the Site or any use of the Site. The user assumes sole and complete responsibility for any and all outcomes resulting from using the Site. The Site may be changed and taken offline at any time for any reason. The reference to any other entity on the Site does not imply endorsement or affiliation.

Limited Liability 

The Site, its directors, employees or agents, will not be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any losses or injuries relating to data, equipment, or health arising from your use of the Site. Notwithstanding anything to the contrary contained herein, the Site's owners' liability to you will not exceed $10. Dispute Resolution 

The Site's owners may demand that any dispute be settled by arbitration. To the fullest extent permitted by applicable law, no arbitration or claim under these terms of use shall be joined to any other arbitration or claim, including any arbitration or claim involving any other current or former User of the Site, and no class arbitration proceedings shall be permitted. In no event shall any claim, action or proceeding by you related in any way to the Site be instituted more than three years after the cause of action arose. 

Agreement

These Terms of Use constitute the entire agreement between you and the Site's owners regarding the use of the Site, superseding any prior agreements. The failure of the Site's owners to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of these Terms of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
